Terms & Conditions

The following Terms and Conditions apply specifically to any purchase or pre-order of any MUBI EDITIONS title. Our Privacy Policy, together with these Terms & Conditions, set out the terms of your use of this website, any purchase, and our basis for any collection and processing of your personal data. Brief general information about processing and fulfilment of orders is available in our FAQs section.

1. Privacy
Shipping addresses and telephone numbers may be shared securely with our fulfilment provider, so that they can package and dispatch the books via Royal Mail or other postal services. Please read our full Privacy Policy. Our Privacy Policy, together with our website Terms of Use, set out the terms of your use of the MUBI website, and our basis for any collection and processing of your personal data.

2. Purchase
By purchasing a MUBI EDITIONS title by pre-order or order, you agree to provide current, complete and accurate payment and delivery information for all purchases. You agree to promptly update your account and other information, including your delivery address, email address, and payment information, so that we can complete your transactions and contact you as needed. In the case that you provide incorrect or out-of-date information to us for your purchase at the date of shipping, you agree to indemnify us for the costs of any re-shipping or replacement, if doing so is possible.

3. Cancellations
There are certain circumstances in which you may withdraw from the contract, namely:

a. You may withdraw your order for goods at any time up to the earlier of (i) the end of the ninetieth (90th) day of purchase, and (ii) the end of the twenty first (21st) working day after you have received the goods. You do not need to give us any reason for withdrawing your order nor will you have to pay any penalty;
b. The only circumstance in which you cannot withdraw your order is where you have taken the goods you have ordered (or the ones in relation to which you want to withdraw) out of the sealed package in which they were delivered;
c. To withdraw your order you must notify us in writing in the details provided in your order confirmation;
d. If you have received the goods before you withdraw your order then, unless you have lost your right to withdraw because you have taken the goods out of their sealed package, you must send them back to us at return address at your own cost and risk, unless the goods were supplied faulty or damaged. If you withdraw your order but we have already processed the goods for delivery and you have received them, you must not unpack the goods when they are received by you and you must send the goods back to us at the return address at your own cost and risk as soon as possible.
e. Once you have notified us that you are withdrawing your order, any sum debited to us from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order.



4. Availability of Goods
In some circumstances, we may place a limit on the number of copies of a particular book, or series of books, that you can order. This may, for example, be where we have limited stocks of a particular book, where a book is signed by an author, or otherwise. Where we are aware of this, we will notify you prior to an order being made. Whether or not we have notified you before you have placed an order, if we have insufficient stock to deliver some or all of the goods ordered by you, or where you have ordered or sought to order (whether in one transaction or multiple transactions, and whether from one or more customer accounts) goods in excess of any quantity limits we have imposed, we will notify you as soon as possible of which parts of your order we will accept and which we will reject. Sums debited (if any) by us from your debit or credit card, or from any other source of payment in respect of goods we are unable or unwilling to supply to you will be re-credited to your account and we will notify you by email at the address given by you in your order form of which orders have been satisfied and which have been rejected. Any refund will be made as soon as possible and in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

5. Liability
Our liability is as follows:

a. If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us of the problem, in writing to us at shop@mubieditions.com within 10 working days of the delivery of goods in question.
b. If you do not receive goods ordered by you within 30 days of the date on which they were dispatched to you, we shall have no liability to you unless you notify us in writing at shop@mubieditions.com of the problem within 40 days of the date on which the goods were dispatched to you.
c. If you notify a problem to us under this condition, our only obligation will be, at our option, to make good any shortage or non-delivery; to replace or repair any goods that are damaged or defective; or to refund to you the amount paid by you for the goods in question to the original method of payment.
d. We will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under paragraph (c) above.
e.  Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence. Nothing in this contract creates any right which is enforceable by any person who is not a party to the contract.


6. Miscellaneous
In the event that any provision of these website Terms of Use is held to be invalid or unenforceable, the remainder of these Terms of Use shall remain valid and enforceable. These website Terms of Use shall be governed by the laws of England and Wales and the English courts shall have exclusive jurisdiction. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of our service.
